The Construction Industry Drug-Free Workplace Program (CIDFWP) is a Trust Fund that has been negotiated into your Union’s collective bargaining agreements. The CIDFWP is governed by our Board of Trustees that meet multiple times a year to discuss relevant issues and policies as it pertains to drug-testing in the construction industry.

Who can participate in the Construction Industry Drug-Free Workplace Program (CIDFWP)?

The CIDFWP is a program that is part of multiple Collective Bargaining Agreements (CBA) for the Carpenters, Laborers, Cement Masons and the Bricklayers Unions. For an employer to be eligible to participate in the program, they must be signatory with at least one of these CBA’s.

How much does it cost to participate in the CIDFWP?

The CIDFWP expenses are all funded by an hourly contribution through the collective bargaining agreement. The current hourly contribution rate is $0.13 per hour for every union employee. This is the only cost an employer will be required to pay for their drug-testing needs through the CIDFWP.

Does the CIDFWP do any regulatory drug-testing?

While we do follow general guidelines of most regulatory drug-testing requirements, we do not currently perform regulatory drug-testing.

What type of testing does the CIDFWP perform?

The CIDFWP provides drug-testing for almost every need. We currently provide pre-employment, pre-job, random, post-accident, reasonable suspicion and follow-up testing for all covered employees.

Type of Test: Enzyme immunoassay (EIA) or any other testing technology that the lab considers appropriate.

Confirmation Test: Gas Chromatography/Mass Spectrometry (GC/MS) or Liquid Chromatography Tandem Mass Spectroscopy (LC/MS/MS), or any testing technology the laboratory considers appropriate.

Drug testing and the chain of custody shall be conducted in accordance with the procedures of the U.S. Department of Health and Human Services Mandatory Guidelines for Federal Workplace Drug Testing Programs and the Department of Transportation, except as modified explicitly under this plan. The cutoff value shall change automatically upon change by such federal agency for those substances addressed by federal guidelines.

Effective January 1, 2019, the following substances will be tested at the indicated levels:

How often are employees tested?

When an employee takes a test and it comes back negative, the CIDFWP issues that member an ID card that is good for up to 12 months from the test date. The employer has the right to retest an employee if the card is older than 6 months. Through the random selection program, we have the testing pool set 150% to 200% on a calendar year basis. That general means that the entire covered population would test at least once a year and half of the population would test twice. But as the random is truly random, some may test more than twice in a calendar year.
